Alina Papanastasiou to present paper on incidental jurisdiction in international adjudication at ASIL 2022 Midyear Meeting

Publications 19th October 2022

Alina Papanastasiou will present her paper, “Ad intelligendum et ad agendum: Understanding and operation of (substantive) incidental jurisdiction in international adjudication”, at the American Society of International Law (ASIL) 2022 Midyear Meeting.

Alina will explore the concept and practical operation of ‘incidental questions’ that often arise before international judicial bodies, such as the International Court of Justice, International Tribunal for the Law of the Sea, inter-State arbitration and investor-State arbitration tribunals, and human rights courts, among others. She will review relevant jurisprudence and contemplate the foundations of the courts’ and tribunals’ power to make ‘incidental’ determinations and attendant implications.

Alina will present her paper as part of the Research Forum on Saturday 12 November in Miami, United States.
