Carmen Martinez Lopez to speak on a panel at 2023 IBA Arbitration Day

Carmen Martinez Lopez will speak at a panel on “The impact of third-party funding on investment arbitration” during the 24th Annual IBA Arbitration Day, hosted by the International Bar Association (IBA). The theme of this year’s conference is “International arbitration in a divided world: a challenge to the system’s legitimacy”.

Over the past decade, the use of third-party funding (TPF) has grown and developed, raising concerns in the field of investment arbitration about the parties’ equality of arms. This panel will discuss whether TPF really facilitates investors’ claims, if and how it has affected access to justice, and the measures so far proposed by the arbitral community to address the alleged imbalance brought to the system by the wider use of TPF. The session chair, Nigel Blackaby KC, will give his views on these developments, and Carmen along with her fellow panellists will provide comments on Nigel’s propositions.

The event will take place on Friday 14 April in Lisbon, Portugal. Carmen’s panel will be the first session of the conference, taking place from 9:45 am to 11:00 am.
